Terms & Conditions

These Terms and Conditions ("Agreement") govern the relationship between the customer ("you") and our mountain bike tour business ("we" or "us") when you participate in any of our mountain bike tours. By booking a tour or service with us, you acknowledge and agree to abide by the following terms and conditions:

Booking and Payment:
a. To secure your reservation, full payment is required at the time of booking.
b. We accept payment via credit/debit card or electronic bank transfer.
c. All prices are quoted in the local currency and include any applicable taxes or fees.

Cancellation and Refunds:
a. If you cancel your tour:
i. More than 24 hours prior to the tour start date, you will receive a full refund.
ii. Less than 24 hours prior to the tour start date, no refund will be provided.
iii. Some of our tours have a cancellation and refund policy specific to the tour, check tour details.
b. We reserve the right to cancel or reschedule a tour due to unforeseen circumstances, including weather conditions or insufficient bookings. In such cases, you will be offered an alternative tour date or a full refund.

Participation and Physical Condition:
a. You must be in good physical health and possess the necessary skills and experience to participate in mountain biking activities.
b. It is your responsibility to inform us of any medical conditions, allergies, or physical limitations that may affect your ability to participate in the tour.
c. We reserve the right to refuse participation to individuals deemed unfit or unprepared for the tour, without any refund.

Safety and Liability:
a. While we take every reasonable precaution to ensure your safety, mountain biking involves inherent risks, and accidents may occur.
b. You acknowledge and accept the risks associated with mountain biking, including but not limited to falls, collisions, and injuries.
c. You are responsible for wearing appropriate safety gear and following the instructions provided by our guides.
d. We are not liable for any personal injury, loss, or damage to your property during the tour, except in cases of our proven negligence or willful misconduct.

Digital Waiver:
All individuals participating in a tour, or hiring a bike, from Tasmanian Mountain Bike Adventures, are obliged to agree and sign our General Waiver prior to commencing the tour or collecting the bike. Our General Waiver and Bike Hire Agreement are online documents and will be emailed to all participants prior to the start of the booking. These documents can also be completed in person at our office.

Insurance:
a. It is strongly recommended that you have personal travel insurance covering medical expenses, trip cancellation, and personal liability.
b. We do not provide insurance coverage for participants and will not be held responsible for any uninsured losses or expenses incurred.

Code of Conduct:
a. You are expected to behave responsibly and respectfully towards our staff, fellow participants, and the environment.
b. Any deliberate damage to property or disruption of the tour may result in termination of your participation without refund.

Changes to Itinerary:
a. We reserve the right to make changes to the tour itinerary, including route modifications, due to weather conditions or unforeseen circumstances.
b. We will make reasonable efforts to provide a suitable alternative, but no refund or compensation will be provided for itinerary changes.

Intellectual Property:
a. Any photographs, videos, or other media captured during the tour may be used for promotional purposes by us, unless you explicitly request otherwise.

Governing Law and Jurisdiction:
a. This Agreement is governed by the laws of Tasmania, and any disputes arising from or related to this Agreement shall be resolved in the courts of Tasmania.

By booking a tour with us, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. It is your responsibility to review this Agreement periodically for any updates or changes.
